Masterclass Cross-examination

Do you have the skills needed to cross-examine expert witnesses?

Cross-examining witnesses and expert witnesses is an important part of an international arbitration hearing. The aim of cross-examination is to undermine the content of written statements and expert reports that the opposing party has produced during the proceedings and to reinforce your own positions. With this in mind, it is important to employ certain techniques and ensure your own expert witness is well prepared. Cross-examining witnesses is not something that Dutch lawyers do every day. During this two-day course you will learn the art of cross-examination.

It is a highly practical, experience-based course for legal professionals. Under the guidance of leading arbitration experts from the Netherlands and the United Kingdom, including Hilary Heilbron, a KC in London, you will learn how to prepare for a cross-examination and what strategies and techniques you can employ. The KC will share tips and tricks to help you cross-examine effectively. The lecturers will also discuss the theory behind cross-examination, including theIBA Rules on the Taking of Evidence in International Arbitration and the Prague Rules on the Efficient Conduct of Proceedings in International Arbitration.

Day 2 will be dedicated entirely to practice. You will be given the chance to conduct short cross-examinations yourself, with experienced employees from PwC acting as expert witnesses. Arbitrators with experience in the field of international arbitration will also be on hand to provide feedback.

At the end of the course you will have the knowledge and skills needed to cross-examine expert witnesses effectively.

  • the Prague Rules on the Efficient Conduct of Proceedings in International Arbitration
  • practical tips and tricks for conducting cross-examinations
