How do UK lawyers approach restructuring mandates?
This lecture will examine the various formal insolvency and restructuring procedures available in English law for corporate debtors. It will also explain how insolvency practice is conducted and regulated in the UK. The intention will be to illuminate ways in which English law and practice may differ from that in other jurisdictions – notably civil law jurisdictions. In that connection, the lecture will focus on schemes of arrangement, the use of out of court procedures, the contrasting roles of the court and the insolvency trustee, the English approach to debtor in possession procedures, recognition of foreign insolvency proceedings and access to English procedures by foreign corporate debtors.
